Terms of Service

Welcome to NewTales. These Terms of Service ("Terms") govern your access to and use of newtales.pro and any related services (together, the "Service"). By creating an account or using the Service you agree to these Terms.

1. The Service

NewTales generates AI-written stories with matching cover art and narrated audio. The Service is operated by Sergey Pinigin, sole proprietor, Varna, Bulgaria ("we", "us", "our"). Full merchant contact details are provided during checkout and in Stripe payment receipts.

2. Accounts

NewTales is intended for adults. To create an account and use the Service you must be at least 16 years old (or such higher age as your local law requires). Parents and guardians may use the Service from their own adult account to generate content (including bedtime stories) for children under their responsibility, but children must not create or operate the account themselves.

  • You are responsible for keeping your password secret and for all activity under your account.
  • You must provide an accurate email address. We may email you transactional messages required to operate the Service.
  • When you create an account you confirm you have read and agree to these Terms and to our Privacy Policy. We record the date and version of your acceptance.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

3. Acceptable use

You agree not to use the Service to:

  • Generate content that is illegal under applicable law (including CSAM, terrorism, hate speech against protected groups).
  • Generate content depicting real identifiable persons in a defamatory, sexual or misleading manner.
  • Circumvent rate limits, attempt to break authentication, or abuse the generation pipeline.
  • Resell the Service or access the API by automated means without written permission.
  • Upload content you do not have the right to use.

We may remove content and suspend accounts that violate these rules, including content flagged by our upstream AI providers.

4. Credits, plans and payments

The Service offers a free tier and a paid Plus subscription, as well as one-time credit packs. Pricing and credit costs per story length are shown on the pricing page and may change with notice for future renewals.

  • Plus subscription: billed monthly via Stripe. Renews automatically until cancelled. Cancel anytime in your account — access continues until the end of the paid period.
  • Credit packs: one-time purchases. Credits do not expire but are non-refundable once used.
  • Monthly Plus credits: granted once per billing cycle and do not accumulate month to month.
  • All prices are shown in USD or EUR and may include applicable VAT.

5. Refunds and 14-day withdrawal

Refunds are governed by our Refund Policy. Under EU consumer law you may have a 14-day right of withdrawal, which is waived once you begin consuming the digital content — that is, once you expressly consent to immediate supply and acknowledge that consent waives the withdrawal right (Directive 2011/83/EU, Art. 16(m)).

6. Your content

  • You retain ownership of the prompts and uploaded text you submit to the Service.
  • Stories, cover images and audio produced by the Service are generated using third-party AI models. To the extent protectable, you receive a worldwide, royalty-free licence to use, reproduce and distribute the generated output for personal or commercial purposes, subject to these Terms and the policies of the underlying AI providers.
  • AI-generated outputs may not be eligible for copyright protection in every jurisdiction.
  • You represent that your prompts and uploaded text do not infringe third-party rights.
  • You grant us a limited licence to store and process your content solely to operate the Service and to display it back to you (and, where you choose to share a story publicly, to serve it to visitors of that share link).
  • You can delete any story from your account at any time from the cabinet (My Account) page.

7. Storage and retention

  • Free tier: generated files are retained for 7 days; metadata may be retained longer.
  • Plus tier: generated files are retained while the subscription is active, plus a 35-day grace period after cancellation.
  • You can delete any story from your account at any time. After account deletion we pseudonymise your record and retain payment and consent metadata as described in the Privacy Policy.

8. Third-party AI providers

The Service uses Anthropic, Google and ElevenLabs to produce output. By using NewTales you acknowledge that your prompts may be sent to these providers and that their usage policies apply to the output. See our Privacy Policy for the full sub-processor list.

9. Disclaimers

The Service is provided "as is" and "as available". AI models can produce inaccurate, offensive or unexpected content; you are responsible for reviewing output before use. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) EUR 50. We are not liable for indirect, incidental, consequential, special or punitive damages. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. for gross negligence or wilful misconduct).

11. Termination

  • You may stop using the Service and request account deletion at any time by emailing privacy@newtales.pro. We delete or pseudonymise your data within 30 days, subject to the retention exceptions in the Privacy Policy.
  • We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Where possible, we will give advance notice.
  • Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) survive.

12. Changes to these Terms

We may update these Terms. Material changes will be announced via email or a notice on the site at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria. Mandatory consumer protections of your country of residence in the EU still apply. Disputes are subject to the jurisdiction of the competent courts in Varna, Bulgaria, unless EU rules assign jurisdiction to the consumer's home court.

If you have a dispute, please contact us first at support@newtales.pro so we can try to resolve it informally. Nothing in this section limits your statutory consumer rights under the laws of your EU country of residence.
